Town counsel: Board can enforce 1989 agreement with shooting club

Town counsel Paul DeRensis Tuesday gave selectmen an opinion that the Independent Sportsmen’s Club’s 1989 written agreement to not conduct shotgun shoots on Wednesday nights in the winter is enforceable.
In a Dec. 18 letter, attorney Mark Stopa notified the board that the club plans to re-instate its Wednesday evening shotgun shoots during the winter months.
Stopa wrote that a certain state law allows the shooting club to operate 8 a.m. to 10 p.m. daily, and that the non-profit club needs the Wednesday night shoots to keep up membership interest and revenues.
In December, 1989, the club “volunteered to limit its winter time evening shotgun schedule to Fridays,” Stopa wrote.
After listening Tuesday to Stopa, DeRensis and resident Karen Apgar of Spruce Street, the board decided to hold a future public hearing to sort out the issue, with comments from other interested residents.
Selectmen chairman Mark Sullivan recused himself from the discussion, because he lives on Spruce Street, about a half-mile from the club, which stands at the end of Mirimichi Road.
